Here you will find a script to make your own. What that means is utilize this script as a guide to create your own personal experience with the client. Stay positive and treat the client with respect and empathy.
Step 1: Introduction
- Representative: “Hello, My name is [Your Name], with McKay Law I’m here to help you, are you ok?”
- “I’m sorry to hear that has happened to you and luckily you were able to find us because McKay Law specializes in [Injury Cause or Type] Claims
- Please tell me in your own words what happened.
McKay Law Introduction
It is very important that you understand who and what McKay Law is. What that means is if you don’t believe that McKay Law is the best choice for a personal injury client then you will never be able to convince the client otherwise.
Always answer the call with confidence! Get comfortable saying your name and the name of the law firm MCKAY LAW! Confidence is Key without it you won’t be able to control the conversation and whoever controls the conversation will win. If you are not able to introduce yourself and the firm with confidence and surety then that conveys discomfort and the client will sense it.
Start the consultation by asking the client their account of what happened. Make sure you actually listen to what they say happened. This is very important that you don’t have to ask them questions they have already answered cuz this will cause frustration with the client. It also shows that you are actually interested in what they have to say.

Details
Its very important to avoid long moments of silence… keep the conversation flowing as natural as possible.
If you feel like they may have already answered a question that you may have and you need to know the answer to then state the fact that “you may have already answered this and that you are sorry for asking again” and then ask the question.
This shows that you are actually listening and that you care but the importance of the question requires you to be sure its answered.
Step 2: Gather Details of the Injury/Incident
Details of the Incident If they don’t mention it on their own… ask:
- Is there a police report?
- Was anyone injured? *If No Click Here
- Have you seen a doctor? *If No Click Here
- Who’s fault was it?
- Were there any witnesses?
- Did you exchange Insurance info?
- Have you been contacted by their insurance company?
- Have you reached out to any other law firms yet?
- Was there more than one vehicle involved in the accident?
- Was there any passengers?
Step 3: Collect Client Information
- Full Name: “Can I please have your full name?”
- Contact Information:
- “What is the best phone number we can reach you at?”
- “What is your email?”
- Date of Birth: “Could you please provide your date of birth?”
I really appreciate you answering those questions I am preparing to send you a document that I need you to sign and send back to me so that we may get started on obtaining the (Examples: Police Report, Medical Records Associated To The Injury, Etc). Its an Electronic document so would you like me to send that to your email or text.
Sending The Contract
Once you realize there is a case don’t ask if they want to hire McKay Law…
LET THEM KNOW:
- You are going to be sending them a document through docusign that they need to sign so that McKay Law will be able to obtain the necessary information to pursue their case (medical records, police reports, etc)
- Ask them if they want it to be texted to them or emailed.
- Let them know that you will be on the phone with them to answer any questions they may have about the document.
- If they cannot sign while you are on the phone with them because they are driving or have other plans… ask them when they may expect to have time to go over the document with you so that if there is any confusion you can provide them with answers.
- No matter if they have time to go over it right away or not, always make sure that they have at least received the document before ending the call.
Step 4: Docusign
Ok I sent the document over please let me know when you receive it. You don’t need to print it just initial and sign and click submit. I will stay on the phone in case you have any questions.
Closing
Once you have completed the signing with the client don't just end it there…
Make sure the client knows what to expect next
If medical treatment is needed go over whats to be expected of them.
Let them know of any future calls to be expected from McKay Law and go over what that individual will be going over with them briefly.
Also inform them that some questions you may have asked today may be re-asked during the next conversation with McKay and to excuse that but its only to make sure we have all the information we need to win their claim.
Step 5: Closing
Ok Excellent I just got the document give me a quick second to look it over to ensure everything is completed. Congratulations everything looks perfect now I want to briefly go over what to expect next:
- An Intake Specialist will be contacting you within the next 24 hours to collect all the information needed to file your claim. This includes photos, witness accounts, and your description of events. They may ask some of the same questions I have asked and I understand that can be frustrating but its all information we need to help you get compensation.
- After your conversation with one of our Intake Specialists your Case Manager will be assigned to you.
Make sure you have answered as much of their questions and let them know not to talk to the insurance company anymore.
Thank them for contacting McKay Law and let them know that we will take it from here and to focus on
What To Expect If They Ask
McKay Law offers a service to their clients involved in accidents to receive compensation for property damage. Most law firms don’t offer this because they are not allowed to charge the client for this service. McKay Law only provides this service to clients with injury claims associated with property damage. Many clients who have visited the emergency room after an accident are told that they are fine and sent home. The ER is not the same as being seen by a specialist. The ER is there to make sure you don’t die before you leave the ER. Explain to the client that just because a nurse or doctor from the ER said that they were fine doesn’t mean that they weren’t injured from the accident.
Ask them qualifying questions to see if they have a case:
- What kind of damage was done to your vehicle?
- What kind of vehicle was it you were in?
- What kind of vehicle were you hit by?
- Were there any passengers with you?
- Were any of your passengers under the age of 18?
- Did you go to the ER?
We treat every accident as an INJURY ACCIDENT because many injuries don’t show damage until later on. Some injuries have life changing results without any pain.
After explaining to the client how the ER is designed and they understand that in order to receive compensation they would need to file an injury claim click here.
Some clients won’t feel pain or realize they have an injury till after time has passed after an accident. Some clients may not have the means to pay for a doctor visit or don’t have medical insurance so they will refuse medical treatment.
McKay Law understands all the different reasons why an individual may not want to seek medical attention and we try to make it as easy as possible for them.
Explain to the client the need for them to see a doctor:
- They can see a doctor without having to pay
- Many injuries don’t show signs until later
- Medical Diagnosis is crucial for compensation
- Early treatment is often the key to healing
It is very important that the client understands that a doctor visit is required to get compensation just like having an adjuster inspect their vehicle for property damage claims.
