Common Rebuttals And Concerns

Here you will find the most common questions and concerns potential clients will have during there initial consultation. Remember to always stay positive and try to have empathy for what the person may be going through.

Office Location Concerns

If a potential client is concerned about location:

Example: 

  • I found you online and it says you are in Houston?
    • Our Principle office is in Sulphur Springs TX but yes we service clients in Houston!
  • I live in Austin and your office is in sulphur springs… How can you help me?
    • We serve clients who have suffered a personal injury all throughout Texas where you are located doesn’t effect the outcome of your case.
  • I want an attorney thats close to me…
    • I understand having an attorney that is close to you makes sense but with personal injury claims we like for you to focus more on healing then having to visit your lawyer. At McKay Law our clients are involved in the entire claims process without having to disturb their normal routine.
  • I can’t come into your office its too far away…
    • No problem! 95% of our clients have never stepped foot in our office. In the rare occasion where an in-person interaction is necessary then McKay Law has no problem coming to you.

There’s no need to oversell the law firm! Control the conversation. If the potential client has a question they will ask and you should answer it and go right back to getting them on board. Be mindful of rambling there is a such thing as overexplaining.

ALWAYS STAY POSITIVE!

Injury often times creates a negative outcome for clients no matter what the subject may be.

Always stay as positive as possible when answering and asking questions.

Overexplaining even when meant to be positive often comes off as a negative even when not intended to be.

Examples:

  • Will I have to pay you guys upfront or out of pocket?
    • That’s a really good question and I’m glad you asked because at McKay Law we only get paid if you WIN!

(You may feel the need to explain this further by telling them what the percent is of the fee or how all expenses like medical, pain and suffering, and or property damage costs come from the settlement… This only opens up new doors to new questions that most clients don’t even have at this point.) Try to answer only the direct question given to you without having to get into details that don’t effect the outcome of their claim.

  • How much is your fee?
    •  How fees vary depending on circumstances and difficulty of the cases, but its never more then 40% and always free unless we win.
  • The Insurance company already contacted me and Offered me $1000…
    • That’s great that means the insurance company recognizes the fact that you have an actual claim. What we do at McKay Law is ensure that you get the maximum amount. 

(Your natural response may be to say how thats not enough or they are trying to scam you… This may be true and $1000 is most likely not enough to cover the damages but by being negative towards the insurance company isn’t necessary. Also stating that “thats not enough” they may start to wonder how much they can get and there’s no way of telling that yet.

  • My family says I shouldn’t trust an attorney cuz all they want is money…
    • Oh yeah I understand I’m sure your family is just trying to look out for you which is great! A personal injury claim is not just about how much you can win but also how much you can save!  What that means is that with the right attorney, negotiations are not only done with the insurance companies but with medical professionals that are involved. No matter what you decide having a GOOD attorney on your side will make sure that the outcome is the best possible one for YOU and not the individual that caused your injury.

(This may seem like a great time to tell the client how great McKay is and that they can trust you and what not… By doing this it will more often times then not cause them to be even more suspicious.)

Whenever being asked a question with a negative or unpleasant connotation you always want to answer it by beginning with a positive response before going into negativity if needed.

I Haven't Seen A Doctor

In order for a compensation for an injury they need to see a doctor first. Many individuals have different reasons why they have not seen a doctor yet or not wanting to now.

Examples:

  • I don’t have insurance…
    • Medical Insurance is not needed. With McKay Law all doctor visits are covered until after we win.
  • I am not in any pain…
    • Many injuries are not visible or felt until long after the accident.
  • I don’t have a way to get there…
    • McKay Law will help get you to and from your doctor visits.
  • I can’t afford to miss work…
    • Without a proper diagnosis or treatment you may not be able to work at all
Be understanding about their reasons for not seeing a doctor yet. Just make sure that they understand that McKay Law is here to help them in any way we can.

Why a Client Calls McKay Law???

A client that calls McKay Law is not calling to understand “WHAT” a personal injury lawyer does. They want to know if they have a case or not and your job is to send a clear message of why McKay is the best choice for them. 

Its important to build a relatable experience with the client. LISTEN TO WHAT THEY ARE SAYING!!!! If they bring up a hospital visit that they enjoyed or didn’t enjoy use that to relate with them.

Example:

I waited in the ER for 6 Hours and when I was finally seen they didn’t even take the time to give me a thorough exam…

  • I’m so sorry to hear that… many of our clients have experienced a similar outcome when visiting the ER and upon visiting our network of Doctors they learn they indeed are injured.

I was seen right away and all the nurses were so nice to me and luckily they said I was Fine

  • Oh I’m so happy to hear that… It definitely could of been much worse. At McKay Law we not only handle your case with the insurance companies but we work directly with Local Doctors and Medical professionals that specialize in this type of situation. Often times the ER is more to make sure you are not going to die but not really set up to properly diagnose “ACUTE Injuries” ACUTE injuries are injuries that require a much more accurate diagnosis and we work with Medical Professionals that specialize in that.
